Throughout these Terms, "GYST", "we", "us" and "our" refer to GYST (SASU).

GYST provides a visual workspace designed to help users capture, explore, organize and create from ideas, information and digital content.

Depending on the features available, GYST may allow you to create boards, canvases and pages; save notes, text, images and files; capture links, bookmarks, webpages and other online content; organize information visually; connect and structure content; use mobile capture tools; interact with AI-powered features; and share or collaborate on content where such functionality is available.

GYST is available through web browsers and, where available, mobile applications for iOS and Android. Features and functionality may evolve over time.

GYST is currently provided free of charge. No subscription fee is required to create an account or use the available features.

We may introduce paid plans, optional paid features or usage limits in the future. If that happens, applicable pricing, conditions and features will be clearly communicated before you are charged or asked to subscribe.

We will not charge you without your explicit agreement.

You must be at least 18 years old to create a GYST account unless we expressly permit otherwise.

When creating an account, you agree to provide accurate and current information, maintain the confidentiality of your login credentials, take reasonable steps to prevent unauthorized access, and notify us promptly if you become aware of unauthorized use.

You are responsible for activity carried out through your account unless that activity results from circumstances for which you are not legally responsible. You may not impersonate another person or create an account using information you are not authorized to use.

You retain ownership of the content you create, upload, capture or store in GYST — notes, text, images, files and documents, links and bookmarks, boards and canvases, pages, tags, organizational structures and other materials you choose to add.

By using GYST, you grant us a limited, non-exclusive license to host, store, reproduce, process and display your content only to the extent reasonably necessary to operate and provide GYST to you. This license does not transfer ownership of your content to GYST.

It ends when your content is deleted or your account is terminated, subject to reasonable technical backup periods and applicable legal retention requirements. Our processing of personal data is described in our Privacy Policy.

You are responsible for the content you choose to upload, capture, store, create or share using GYST, and you represent that you have the rights necessary to use that content within GYST.

GYST does not claim ownership of third-party material you save or reference within your workspace. Saving, embedding or linking to third-party content through GYST does not grant you intellectual property rights in that content.

GYST and its underlying technology, software, interface, visual design, brand, trademarks, logos and original materials are owned by or licensed to GYST. These Terms grant you a limited, personal, non-exclusive, non-transferable and revocable right to use GYST in accordance with these Terms.

Except where permitted by applicable law, you may not copy or redistribute GYST's software, sell or sublicense access to GYST, reverse engineer the service, attempt to obtain its source code, circumvent technical or security restrictions, or use GYST's trademarks or branding without authorization.

Nothing in these Terms transfers ownership of GYST's intellectual property to you.

GYST may provide features powered by artificial intelligence. AI functionality may use information from your board, page, workspace or prompt to provide contextual responses or perform actions you request.

AI-generated outputs may contain errors, be incomplete or inaccurate, or produce unexpected results. You are responsible for reviewing AI-generated outputs before relying on, sharing or publishing them.

GYST should not be used as a substitute for qualified legal, medical, financial or other regulated professional advice. Our processing of data in connection with AI functionality is described in our Privacy Policy.

GYST may allow you to save, embed, link to or interact with third-party websites, content or services. These services are operated independently from GYST.

We do not control and are not responsible for third-party websites, third-party content, the availability of external services, changes made by external platforms, third-party privacy practices or third-party contractual terms. Your use of third-party services remains subject to their own terms and policies.

You agree not to misuse GYST. In particular, you must not:

• Access another user's account without authorization.
• Interfere with or disrupt GYST's infrastructure.
• Probe, scan or test vulnerabilities without authorization.
• Circumvent technical or security restrictions.
• Introduce malware or malicious code.
• Use GYST for unlawful activity, or to infringe the rights of others.
• Scrape or automatically extract data in a way that materially interferes with the service.
• Attempt to overload, damage or compromise our infrastructure.

Reasonable automated use through functionality or APIs expressly provided by GYST is permitted in accordance with applicable documentation and technical limits.

We welcome feedback, suggestions and ideas about GYST. If you voluntarily provide feedback, you authorize GYST to use it to develop, improve and promote the service without obligation to compensate you.

This does not transfer ownership of your private workspace content to GYST.

We aim to provide a reliable and accessible service, but we cannot guarantee uninterrupted or error-free operation.

We may temporarily restrict access where reasonably necessary for maintenance, security, infrastructure changes, product updates, emergencies or events outside our reasonable control. We may also modify, add or remove features as GYST evolves.

Where required by applicable law, we will provide appropriate notice of material changes affecting users.

We take reasonable technical measures to operate and protect GYST. However, you should maintain independent copies of content that is important, critical or irreplaceable.

Nothing in this section excludes any responsibility that cannot lawfully be excluded.

If you download GYST through the Apple App Store or Google Play Store, your use of the relevant platform is also subject to that platform's terms.

Apple and Google are not parties to these Terms between you and GYST and are not responsible for providing support for GYST except where their own terms require otherwise. Where app-store rules impose additional mandatory terms, those rules also apply.

We may suspend, restrict or terminate access to GYST where reasonably necessary, including where you materially violate these Terms, your use creates a security risk, your activity is unlawful or materially interferes with other users or the service, or we are legally required to do so.

Where appropriate and legally required, we will provide reasonable notice before terminating an account. We may act immediately where necessary to address fraud, security threats, illegal activity or serious harm.

You may stop using GYST at any time. You may also delete your account through the functionality made available within GYST, or by contacting hi@gyst.studio.

Information regarding deletion and retention of personal data is provided in our Privacy Policy.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law. These Terms do not limit mandatory statutory rights available to consumers.

To the maximum extent permitted by applicable law, GYST is not responsible for indirect or unforeseeable losses that do not result directly from our breach of these Terms.

For users acting exclusively for professional or business purposes, and to the extent permitted by law, GYST's total aggregate liability arising from use of the service will not exceed €100. This limitation does not apply where liability cannot legally be excluded or limited.

Our collection and processing of personal data are governed by our Privacy Policy, available at gyst.studio/legal/privacy-policy.

Please review it for information about how GYST collects, uses, stores and protects personal data.

We may update these Terms as GYST evolves or where necessary to reflect changes to the service, new functionality, changes to our business model, changes in applicable law, or security and regulatory requirements.

The latest version will always display its effective date. Where required by applicable law, we will provide reasonable notice of material changes.

If you are a consumer and have a complaint concerning GYST, please contact us first at hi@gyst.studio. We will attempt to resolve the issue directly.

Consumers may have access to a consumer mediation procedure in accordance with applicable French and European consumer law. Where legally required, details of GYST's designated consumer mediator will be made available on our website or provided upon request.

These Terms are governed by French law. If you are acting as a consumer, this choice of law does not deprive you of mandatory consumer protections that apply to you under the laws of your country of residence.

Any dispute will be submitted to the courts having jurisdiction under applicable law. For disputes between GYST and users acting exclusively for professional or business purposes, the competent courts of Paris, France shall have jurisdiction to the extent permitted by applicable law.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
